These Terms and Conditions (“Agreement”) govern your use of Mappoji Commodity Indonesia’s (“we,” “us,” or “our”) export coconut services (“Services”). By using our Services, you agree to be bound by this Agreement. If you do not agree to this Agreement, you may not use our Services.
You agree to comply with all applicable laws and regulations related to the export of goods and services, including but not limited to the Export Administration Regulations and the Foreign Corrupt Practices Act. You acknowledge that our Services may be subject to export control laws and regulations and that we may not provide our Services to countries or individuals that are subject to trade sanctions or embargoes.
We provide export services, including the sale and delivery of coconut and its derivatives to customers worldwide. We use our extensive network of suppliers and partners to fulfill orders and provide related services, such as shipping and logistics support.
You may place orders for our coconuts through our website or by contacting us directly via WhatsApp or email. We reserve the right to accept or reject any order at our sole discretion, including if we suspect fraud or a violation of these terms. Prices for our coconuts are subject to change without notice, and we are not responsible for any errors or omissions in pricing.
Payment for our coconuts must be made in advance, and we will not ship any coconuts until payment has been received and cleared. We only accept payment by bank transfer as agreed upon in writing. You agree to pay all fees and charges associated with your order, including shipping and handling fees and any applicable taxes or customs duties.
We will ship our coconuts to you or to your designated recipient in accordance with the shipping instructions you provide. We will use reasonable efforts to ship your coconuts in a timely manner, but we are not responsible for any delays or errors caused by shipping companies or other factors beyond our control, such as weather, customs clearance, or transportation disruptions.
We will provide tracking information for your shipment, but the risk of loss or damage to the coconuts passes to you upon delivery to the shipping carrier. We are not responsible for any loss or damage to the coconuts during shipping or delivery.
You are responsible for inspecting the coconuts upon delivery and notifying us of any damages or defects within 3 days of delivery. We may require photographic evidence of the damages or defects before we process any refund or replacement.
We warrant that our coconuts will conform to the specifications and description provided to you at the time of purchase. However, we make no other warranties, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Your liability to you for any damages arising out of or related to this Agreement or our Services, whether in contract, tort, or otherwise, is limited to the amount you paid for the coconuts giving rise to such damages. In no event will we be liable for any indirect, special, consequential, or punitive damages, including without limitation lost profits or business interruption.
Our website, including all content and materials, is protected by copyright, trademark, and other intellectual property laws in force in Indonesia. You may not use our website or content for any commercial or unauthorized purposes without our prior written consent.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our Services or your breach of this Agreement.
This Agreement will be governed by and construed in accordance with the laws of Indonesia. Any disputes arising out of or related to this Agreement or our Services will be resolved exclusively in the state or federal courts located in Makassar, South Sulawesi, Indonesia, and you consent to the jurisdiction and venue of such courts.
We may amend or modify this Agreement at any time by posting the amended Agreement on our website or by notifying you by email or other means. Your continued use of our Services after such amendment or modification will constitute your acceptance of the amended Agreement.
Either party may terminate this Agreement at any time by giving written notice to the other party. Upon termination, you must immediately cease using our Services and return any coconuts you have not yet paid for.
This Agreement constitutes the entire agreement between you and us with respect to our Services and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral. No waiver of any provision of this Agreement will be effective unless in writing and signed by both parties.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
